ARTICLE 1

DEFINITIONS

For the purposes of the present Agreement:

1. the term "Customs Administration" means in the United States of America, United States

Customs and Border Protection and United States Immigration and Customs

Enforcement, which are both components of the Department of Homeland Security, and in the Swiss Confederation, the Federal Customs Administration, Federal Department of Finance;

2. the term "customs laws" means the laws and regulations enforced by the Customs

Administrations concerning the importation, exportation, and transit or circulation of goods as they relate to customs duties, charges, and other taxes or to prohibitions,

restrictions, and other similar controls relating to the movement of controlled items across national boundaries;

3. the term "information" means data in any form, documents, records, reports, or certified

copies thereof relating or not relating to an identified or identifiable individual;

4. the term "customs offense" means any violation or attempted violation of the customs

laws;

5. the term "person" means any natural or legal person;

6. the term "requesting Administration" means the Customs Administration that requests

assistance;
